Background

Under s 93A of the Freedom of Information Act 1982 (FOI Act) the Australian Information Commissioner has power to issue written guidelines for the purposes of the FOI Act.

Australian Government agencies and ministers are required to have regard to any guidelines issued by the Information Commissioner when performing a function or exercising a power under the FOI Act.

The OAIC has reviewed agency compliance with the disclosure log requirements in s 11C of the FOI Act and updated Part 14 (Disclosure log) in light of the findings and recommendations made in the Disclosure Log Desktop Review Report.

Purpose of consultation

The OAIC seeks comment from interested stakeholders on the content, guidance, readability and accessibility of the updated Part 14 of the FOI Guidelines.

We welcome your suggestions for any additional resources you think will assist in complying with the disclosure log requirements in the FOI Act.
