Background
On 19 December 2023, the Australian Information Commissioner received an application by the Australian Retail Credit Association (ARCA) to vary the Privacy (Credit Reporting) Code 2014 (the CR Code) in accordance with section 26T of the Privacy Act 1988. This application follows consultation conducted by the CR Code developer, ARCA, throughout 2023 in accordance with the OAIC’s Guidelines for Developing Codes.
This application gives effect to proposals outlined in the OAIC’s independent review report of the CR Code. In that report, the OAIC made 19 proposals regarding CR Code amendments which it considered were required. These proposals are summarised on pages 9 to 10 of the report.
